OBBBA Tax Deduction for Rideshare & App-Based Drivers

Rideshare drivers (Uber, Lyft) and app-based delivery drivers (DoorDash, Instacart, and similar) are almost always classified as independent contractors, not employees. That changes two things: the tip deduction is capped by your net business income, and you owe self-employment tax instead of standard FICA withholding.

Qualifies

  • In-app tips from riders or delivery customers
  • Cash tips handed to you directly
  • Tip income up to your net income from the driving business — the deduction cannot exceed what you actually netted after deducting mileage and other business expenses

Doesn't qualify

  • Tip income beyond your net business income for the year — the self-employed cap limits the deduction to what you actually earned from the business, not the raw tip total
  • Your per-ride or per-delivery fare itself — only the tip portion is the target of this deduction
  • Surge pricing, promotions, or platform bonuses — these are business income, not tips

Worked example

A single filer with $0 base wages + $6,000 in tips (federal only — your state may also tax this income; check the State Conformity Tracker):

  • Net OBBBA deduction: $6,000
  • Estimated federal tax saved: $600
  • FICA still owed on tips: $459 — not reduced by this deduction

Common questions

Why is my deduction capped differently than a W-2 tipped worker?

Because you're self-employed, the OBBBA caps your tip deduction at your net income from the driving business (tips and fares minus deductible expenses like mileage) — not just the $25,000 statutory cap that applies to everyone.

Do I still owe Social Security and Medicare tax on my tips?

Yes — as a self-employed driver you pay self-employment tax (15.3%, covering both the employee and employer share) on your net earnings, tips included. The OBBBA deduction reduces federal income tax, not self-employment tax.

Does this change my quarterly estimated tax payments?
